GENERAL TERMS AND CONDITIONS OF THE ONLINE STORE
(Tickets, Flex Tickets, Gift Vouchers)

2. General Provisions
These General Terms and Conditions govern the operation of the online store of Terme Čatež d.d. and the online purchase of tickets, flex tickets, and gift vouchers via the website
https://ticket.terme-catez.si.
The terms and conditions are prepared in accordance with the applicable legislation of the Republic of Slovenia, in particular the Consumer Protection Act (ZVPot-1).
By placing an order, the customer confirms that they are familiar with and fully agree to these terms and conditions.
3. Definitions

Consumer means a natural person who purchases goods or services for purposes outside their trade, business, or profession.

Daily Ticket means a ticket for the Thermal Riviera valid for a specific date selected by the customer at the time of purchase.

Flex Ticket means a ticket that is not linked to a specific date at the time of purchase and is valid for 12 months from the date of purchase.

Gift Voucher means an electronic value voucher in EUR issued by the provider, valid for 12 months from the date of issue, redeemable with the provider in accordance with these terms and conditions, and not redeemable for cash.
4. Conclusion of Contract, Delivery, and Invoice
After placing an order and successful payment, the customer receives an email from eshop@terme-catez.si containing:

confirmation of the successfully completed order,
-
order summary,
-
invoice for the purchase (attached),
-
purchased tickets or gift vouchers in electronic form (attached).
The contract is concluded on the day the order confirmation is received.
The provider reserves the right to cancel an order if it cannot be fulfilled due to technical or other reasons. In such cases, the customer will be informed of the reason, and if the order has already been paid, the full purchase amount will be refunded.
5. Prices and Payment
All prices in the online store are stated in EUR and include VAT.
Prices apply at the time the order is placed and have no predetermined validity period.
Payment methods:

credit card (Visa, Mastercard / Eurocard, Diners)
Before submitting the order, the customer must explicitly confirm that the order implies an obligation to pay.
6. Validity and Use of Tickets
6.1 Daily Tickets
A daily ticket is valid exclusively for the selected date and within the regular opening hours of the Thermal Riviera, in accordance with the bathing rules.
6.2 Flex Tickets
A flex ticket is valid for 12 months from the date of purchase.
It may be used during the regular opening hours of the Thermal Riviera, in accordance with the bathing rules.
After the expiry of its validity, a flex ticket cannot be extended and cannot be exchanged for cash.
7. Right of Withdrawal from the Contract
7.1 Gift Vouchers
A gift voucher is valid for 12 months from the date of issue and is not redeemable for cash.
In accordance with Article 134 of the Consumer Protection Act (ZVPot-1), the consumer has the right to withdraw from the contract for the purchase of a gift voucher within 14 days of concluding the contract, provided that the voucher has not been used. The withdrawal period begins one day after receipt of the voucher.
Withdrawal must be communicated by a clear and unequivocal statement sent to info@terme-catez.si.
If the consumer withdraws from the contract, the company shall refund all payments received without undue delay, and no later than 14 days, using the same payment method as used for the original transaction, unless the consumer expressly agrees otherwise and provided that no additional costs are incurred by the provider.
7.2 Daily Tickets – Exception to the Right of Withdrawal
In accordance with point 12 of Article 135 of the Consumer Protection Act (ZVPot-1), the consumer does not have the right to withdraw from the contract for the purchase of daily tickets for pools, saunas, or wellness services, as these constitute reservations of leisure services to be provided on a specific date.
Refunds are not possible in the following cases:

non-attendance (“no-show”),
-
illness,
-
incorrectly selected date,
-
changes in personal plans.
7.3 Compensation Policy for Daily Tickets (Goodwill Voucher)
In individual cases concerning daily tickets, where there is no statutory obligation to refund, the provider may, at its sole discretion, grant compensation in the form of a gift voucher as an act of goodwill.
7.4 Flex Tickets
Since flex tickets are not linked to a specific date at the time of purchase, the consumer has the right, in accordance with ZVPot-1, to withdraw from the contract within 14 days of conclusion, provided that the flex ticket has not been used or activated.
Withdrawal must be communicated to info@terme-catez.si.
After the first use or activation of the flex ticket, the right of withdrawal expires.
8. Issuance of Gift Vouchers as Compensation
8.1 Issuance and Validity of the Gift Voucher
If compensation is approved pursuant to point 7.3, a gift voucher will be issued:

in the amount of the purchase price paid or another agreed amount,
-
in electronic form (PDF or code), sent to the customer’s email address,
-
with a validity of 12 months from the date of issue,
-
redeemable exclusively with the provider at ticket offices,
-
not redeemable for cash and not payable in monetary form,
-
transferable.
8.2 Claim Procedure
Requests for the issuance of a gift voucher must be submitted to info@terme-catez.si, stating:
-
the order number,
-
the customer’s name and contact details,
-
the reason for the request.
The provider reserves the right to request appropriate supporting documentation (e.g. medical certificate) and to assess the justification of the request.
The customer will receive a response within 8 days.
9. Protection of Personal Data
The provider undertakes to permanently protect all personal data of users in accordance with GDPR and ZVOP-2.
Personal data will be used exclusively for the purpose of fulfilling orders and necessary communication and will not be disclosed to unauthorized third parties.

10. Copyright-Protected Content
All textual and graphic content of the online store (images, icons, logos, etc.) is the property of Terme Čatež d.d. and may not be copied or used in any form without prior written consent, regardless of the purpose.
11. Complaints and Out-of-Court Dispute Resolution
For additional questions or information, customers may contact customer support at info@terme-catez.si.
The provider will respond to any complaint within the statutory period of 8 days.
In accordance with applicable legislation, the provider does not recognize any out-of-court consumer dispute resolution body as competent for resolving consumer disputes.

12. Final Provisions
The provider reserves the right to amend these General Terms and Conditions.
For each individual purchase, the terms and conditions valid at the time of conclusion of the contract shall apply.
The interpretation and application of these terms and conditions shall be governed by the laws of the Republic of Slovenia.
